Dear Judge Walker,
I highly appreciate the act of your recusal from the divorce case (index # ).
Please note that there is high possibility that Judge Bellantoni, to whom you intend to transfer my divorce case, has potential conflict of interests and therefore transferring the case to him may compromise the benefits for the judicial process, stemming from your recusal.
1. As you certainly know and can see from Exhibit 1, Judge Bellantoni has served as a Court Attorney/Principal Law Clerk to your Honor in a Family Court between March 2002 and January 2003.
I believe that you are highly interested in covering up the mistakes that you made in the period January 2006 – July 2006 while handling my divorce and family/criminal (malicious prosecution) cases. Therefore, the transfer of these cases to a Judge that might be closely connected to you and whom you might intend to influence to cover up your previous inappropriate or illegal activities will not be beneficial to serving Justice.
2. Exhibit 2 shows that the attorney of my wife Neveen Neshewat contributed recently to the election campaign of Judge Bellantoni and belongs to a group of people, calling themselves “Friends of Judge Bellantoni”.
Since Ms. Nesheiwat is highly motivated in the outcome of my divorce case (she might ultimately get a bigger share of my savings than her client), it would be inappropriate for Judge Bellantoni to take over my divorce case.
3. During a June 2006 court appearance that I had before you with my counsel Mr Salant, you told Mr Salant that you would transfer my divorce case to a regular matrimonial Court (not IDVC). I expect and will highly appreciate if my divorce case is transferred to a Judge, who is experienced and currently actively handling divorce cases in White Plains Supreme Court. This would defer any doubt of you continuing to influence my case.
